MODULE · AML ASSISTANT

Anti-money-laundering duties: done and evidenced.

The duties under the German Money Laundering Act (Geldwäschegesetz, GwG) are unpopular but unrelenting: identification, documentation, and a report where there is doubt. NotarFlow runs the duties per matter as a checklist and files the documentation so it stands up to an audit.

IN DETAIL

From the identity document to the file.

Duties per matter type, created automatically.

The fitting GwG checklist comes into being with the matter: who has to be identified, which evidence is needed, whether enhanced due diligence applies. None of it has to be carried in someone’s head.

  • Checklist per matter type, adapted to how you work
  • Beneficial owners are asked after systematically
  • The state of the duties visible at any time

Identity documents and evidence kept with the matter.

Copies of identity documents, register extracts, powers of attorney: everything sits with the matter, with the date it was recorded and where it came from. Nothing is missing at the notarisation, and years later it can be shown what was on file when.

  • Documents assigned to the duty they satisfy
  • Missing evidence as a gap, as everywhere in the system
  • Retention periods kept in view

Documented for the supervisor. Decided by you.

The anti-money-laundering documentation comes into being along the way and can be called up in audit-proof form. Whether a set of facts has to be reported is not decided by the system: findings are put to you, and the assessment stays with the notary.

  • Complete documentation per matter, exportable
  • Findings as a note, never as an automatic report
  • Stands up to the notarial chamber and the supervisory authority

QUESTIONS ABOUT THIS MODULE

Answered briefly.

Does the system report to the FIU?
No. It documents and points out findings. The assessment and any report remain exclusively with you. The FIU is Germany’s Financial Intelligence Unit, the body that receives suspicious activity reports.
Does the module check the transparency register?
It carries the check as a duty and files the result. The register enquiry itself runs through the access you already have.
Does this help in an inspection by the notarial chamber?
Yes, that is exactly what the documentation is built for: complete per matter, dated and exportable.
